"Эйблман против Бута"Прецедентное дело в Верховном суде США [ Supreme Court, U.S.] (1859). Суд в своем решении подтвердил конституционность Закона о беглых рабах [Fugitive Slave Act] и указал, что решение Верховного суда штата Висконсин, освободившего редактора-аболициониста от ответственности за нарушение закона, противоречит Конституции. Указывалось также, что суд штата не вправе начать судебное преследование заключенного, содержащегося под стражей в федеральной тюрьме. юрСудебный приказ о доставлении в суд лица, содержащегося под стражей. Арестованный доставляется в суд прежде всего для выяснения правомерности его содержания под стражей. Это право арестованного защищено Конституцией США [ Constitution, U.S.] и согласно разделу 9 Статьи I, его действие не может быть приостановлено, "если только того не потребует общественная безопасность в случае мятежа или вторжения". Во время Гражданской войны [ Civil War] президент А. Линкольн [ Lincoln, Abraham] временно приостановил действие этой привилегии, а в 1866 Верховный суд США [ Supreme Court, U.S.] в деле по заявлению Миллигана [ Ex parte Milligan] признал это распоряжение А.
